These Terms of Service (the "Terms") govern your access to and use of mortgageprotectioncompany.com and any related services (collectively, the "Site"), operated by Mortgage Protection Company ("we," "us," "our"). Please read them carefully. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Acceptance of these Terms

Using the Site — browsing, reading articles, submitting a form, subscribing to email, or otherwise interacting with the Site — constitutes acceptance of these Terms and of our Privacy Policy. If you are using the Site on behalf of another person or entity, you represent that you are authorized to bind that person or entity to these Terms.

2. Description of the service

Mortgage Protection Company publishes educational content about mortgage protection insurance and related topics, and connects consumers who request quotes with licensed insurance partners authorized to sell in the consumer's state.

We are not an insurance agency. We do not sell, underwrite, issue, or quote insurance policies. We do not hold an insurance license. We do not represent any insurance carrier. When you request a quote match, the quoting, application, and sales process is handled entirely by a licensed insurance partner — an independent agent or agency that is licensed, appointed with the relevant carrier(s), and responsible for that work under applicable state insurance law.

The educational content on the Site is general information, not advice about your specific situation.

3. Eligibility

To use the Site's quote-matching features or submit any form that authorizes contact by a licensed agent, you must:

  • Be at least 18 years old
  • Be a resident of the United States
  • Be legally capable of entering into a contract in your jurisdiction
  • Provide information that is truthful, accurate, and current, and that you are authorized to provide

We reserve the right to refuse service, terminate accounts, or cancel matches at our discretion, including for violation of these Terms.

4. Not insurance, legal, financial, or tax advice

Content on the Site is published for general informational and educational purposes only. It is not, and should not be relied upon as:

  • Insurance advice
  • Legal advice
  • Financial or investment advice
  • Tax advice
  • A recommendation to purchase or decline any specific insurance product

Insurance needs are individual. Rules, rates, and product availability vary by state and change over time. Before making any decision about mortgage protection insurance, life insurance, or any other financial product, consult a licensed professional appropriate to your situation — including, where appropriate, a licensed insurance agent (such as one you are matched with through the Site), an attorney, a CPA, or a fiduciary financial advisor.

Nothing on the Site creates a client, agent, fiduciary, or advisory relationship between you and Mortgage Protection Company.

5. Your submissions and representations

When you submit information through the Site — including through a quote-match form, contact form, or email — you represent and warrant that:

  • The information you provide is true, accurate, and current.
  • You are the person identified in the submission, or you are authorized to submit information on that person's behalf.
  • You own, or have the authority to provide, the phone number, email address, and other contact information in the submission.
  • Your submission does not violate any law, contract, or third party's rights.

You are responsible for the accuracy of what you submit. We may rely on your submission, and our partners may rely on it, when providing quotes or contacting you.

6. Consent to contact

When you submit a form that includes a TCPA consent disclosure, you authorize Mortgage Protection Company and/or the licensed insurance partner(s) we match you with to contact you at the phone number and email address you provided. That contact may include live calls, prerecorded messages, voicemails, and SMS messages, and may use automated dialing systems. Message and data rates may apply.

Your consent to receive these communications is not a condition of using the Site or of purchasing insurance. You can opt out at any time by telling the caller to stop, replying STOP to an SMS, or emailing privacy@mortgageprotectioncompany.com. Complete details are in our Privacy Policy.

7. Commission disclosure

We earn a commission when a consumer we match with a licensed insurance partner purchases a policy through that partner. The commission is paid by the partner out of the partner's own revenue. The commission does not change the premium you pay.

8. Intellectual property

All content on the Site — articles, graphics, logos, layout, code, and the compilation thereof — is the property of Mortgage Protection Company or its licensors and is protected by U.S. and international intellectual property laws.

You may:

  • View and read content on the Site for personal, non-commercial use
  • Quote short excerpts of articles with attribution and a link back to the source article, consistent with fair use

You may not, without our prior written permission:

  • Republish our content, in whole or in substantial part, on another site or publication
  • Use our content to train, fine-tune, or evaluate a machine-learning model other than for personal, non-commercial evaluation
  • Use our trademarks, logos, or brand identity in a way that implies endorsement or affiliation
  • Systematically scrape the Site at a rate or volume that impairs its operation

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

We do not warrant the acts, omissions, quotes, or advice of any licensed insurance partner or other third party. Your relationship with a licensed partner is between you and that partner.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MORTGAGE PROTECTION COMPANY, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR USE OF THE SITE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Mortgage Protection Company and its owners, officers, employees, contractors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your submissions, (c) your breach of these Terms, or (d) your violation of any law or the rights of any third party.

13. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights.

Any dispute arising out of or related to these Terms or the Site shall be resolved by binding individual arbitration, except that either party may bring an individual action in small-claims court in a court of competent jurisdiction.

  • Arbitration administrator: the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced.
  • Location: at the user's option, the arbitration will be held either in Bonner County, Idaho, or in the county of the user's residence.
  • Class action waiver: All disputes will be resolved on an individual basis. You and we agree not to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative action.
  • Opt out: You may opt out of arbitration by sending a written notice to legal@mortgageprotectioncompany.com within 30 days of first accepting these Terms, stating your name, address, and intent to opt out.

If the class action waiver above is held unenforceable, the entire arbitration agreement in this Section 13 shall be void, but the remainder of these Terms shall remain in effect.

14. Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law principles. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Bonner County, Idaho, and you consent to personal jurisdiction there.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide notice on the Site. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.

16. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and any additional terms referenced on the Site, constitute the entire agreement between you and us regarding the Site.
